GENERAL TERMS AND CONDITIONS
Scope
These General Terms and Conditions ("Terms") aim to inform you about Benov Partners Consulting Trade Corporation's ("Fanself") website www.fanself.com ("Platform").
By registering on the Platform, you are deemed to have accepted the Terms below without any limitations or restrictions. If members do not accept and approve these Terms, they should not continue using the Platform. Continued use of the Platform means acceptance of these Terms.
Fanself reserves the right to make unilateral changes to the Terms on this page at any time without prior notice. Changes will be notified to members via email to their registered email addresses on the Platform and/or via text message to their phones.
All products on the Platform are original licensed products and are under the responsibility of manufacturer or importer companies. Fanself has no responsibility for the quality, characteristics, or features of these products.
Right to Make Changes to the Platform
Fanself reserves the right to modify all services and Terms provided on the Platform, any information provided on the Platform, reorganize and redesign the Platform, and suspend or remove the Platform without prior notice and unilaterally. Accessing the Platform constitutes acceptance of such possible changes. Fanself accepts no responsibility for interruption, malfunction, negligence, deletion, loss, delay in transaction or communication, virus, communication error, theft, destruction or unauthorized access to records, their modification or use resulting from any violation of the Terms, tort, negligence or other causes.
Intellectual Property Rights
All visual and written material on the Platform, including the applied sales system, business method and business model, are owned by Fanself and are protected under relevant Turkish legislation including Law No. 5846 on Intellectual and Artistic Works and Law No. 6769 on Industrial Property Rights and international copyright laws. It is prohibited to copy, modify, publish and distribute partially or completely any information on the Platform or any database, software, visual material related to the Platform for commercial or personal purposes without prior permission. In cases where violations are detected, Fanself reserves the right to initiate necessary legal proceedings.
User Account
To use certain features of the Platform, the member must register on the Platform and provide the information requested in the Platform registration form. In this registration form, the member declares and undertakes that: (a) all necessary registration information submitted by the member is reliable and accurate and will remain accurate, and (b) the member's use of the application does not violate any applicable legislation or Terms.
The member is obligated to protect the confidentiality of their account login information on the Platform. The member is responsible for all activities associated with the relevant account (including but not limited to any purchases, Platform usage). If unauthorized use of the user account occurs on the Platform or through the Platform, the member must immediately notify Fanself. If the member makes such a notification to Fanself, Fanself may suspend or otherwise secure the member's Platform account to prevent unauthorized use again. Fanself reserves the right to completely or temporarily close access to the Platform in accordance with notifications made to it by members in this context.
Necessary measures for the security of information and transactions entered into the Platform by the member have been taken in Fanself's system infrastructure to the extent technically possible according to the nature of the information and transaction. Due to the entry of said information from the member's device, the responsibility for taking necessary measures, including those related to viruses and similar harmful applications, to protect the information on the member's side and prevent access by irrelevant persons lies with the member.
Use of the Platform
It is prohibited to use the Platform to transmit or communicate any materials that constitute a violation, are threatening, false, misleading, abusive, defamatory, slanderous, obscene, indecent, provocative, pornographic or profane, or that would constitute an act that would create criminal or legal liability and would otherwise violate any legislation or encourage such an act. Likewise, the member cannot use personal information such as IP address, email address, username belonging to another person in the internet environment, nor can they access or use other users' private information without permission. The member is deemed to have accepted all legal and criminal liability that may arise from such use.
While benefiting from the Platform and its services, the member agrees to comply with the Personal Data Protection Law, Turkish Criminal Code, Turkish Commercial Code, Law on Intellectual and Artistic Works, Industrial Property Law, Law on Protection of Trademark, Design and Patent Rights, Regulations, Decree Laws and all other legal regulations, Code of Obligations, other relevant legislation provisions and all kinds of announcements and notifications to be published on the Platform. All legal, criminal and financial responsibility that may arise due to use contrary to these notifications and laws belongs to the member.
All intellectual and industrial rights and property rights regarding all kinds of information and content on the Platform and their arrangement, revision and partial or complete use belong to Fanself, except those belonging to other third parties according to Fanself's agreement.
The member accepts, declares and undertakes that they will not use software that will threaten the security of the Platform, prevent the operation of the Platform and software used, not engage in actions that prevent or make it difficult for other users and visitors to use the Platform, not force or lock servers or databases by loading automatic programs, and not attempt fraud. In case such activities are performed, attempted, and information is obtained, deleted, modified, the member's membership will be terminated and they will be held responsible for the resulting damage.
The relationships of Platform users with each other or third parties are the responsibility of individuals. Links may be provided through the Platform to other websites and/or other content that are not under the Platform's control and are owned and operated by third parties. These links are not intended to support any website or person operating that site and do not constitute any kind of statement or guarantee regarding the information contained on the website. Fanself has no responsibility for websites and content accessed through links on the Platform, and any damage that may arise due to their use is the responsibility of the member. Fanself may make access to such linked websites subject to its written consent, and may also cut off access to links it deems inappropriate at any time.
The member is directly responsible for any damage that will arise from sharing information such as username and password given to the member or determined by themselves, usage rights, with third parties or organizations (use of this information by persons other than the member). Fanself reserves all rights to compensation and other claims against all claims and demands that may be asserted against Fanself by third parties or authorized authorities due to any responsibility that may arise for this reason.
Different rules and obligations specific to that section may be specified in certain places of the Platform. If the member uses the section in accordance with the information provided to them regarding those sections, the member is deemed to have accepted the rules specified in that section.
Membership cancellation and account deletion can be done by applying through the Platform by the member.
Limitation of Liability
Fanself makes maximum effort to keep the information on the Platform up-to-date and valid. Fanself reserves the right to make changes to data and products on the Platform without prior notice.
Fanself is not responsible for any direct or indirect damages that may arise due to accessing the Platform, using the Platform or information and other data on the Platform, any violation of the Terms, tort or other reasons. Fanself accepts no responsibility in case of interruption, error or negligence in transactions conducted through the Platform as a result of any violation of the Terms, tort, negligence or other reasons. Fanself will not be responsible for any damage, including any kind of risk, liability, court costs and other expenses that may arise as a result of using the Platform.
Fanself cannot be held responsible to members for problems that may arise due to typographical errors (product/service name, product/service price product/service terms and conditions).
Applicable Law and Competent Court
In disputes that may arise from these Terms and use of the Platform, primarily the provisions in these Terms; in cases where there are no provisions in these Terms, the legislation of the Republic of Turkey will apply. Istanbul Anatolian Courts and Enforcement Offices will be competent in resolving any disputes that may arise from or in connection with these Terms and use of the Platform.
Confidentiality
During the period these Terms are in effect and after the termination of the Terms, the parties cannot disclose any information and documents ("Confidential Information") communicated to them in written, verbal or other form to third parties without the written approval of the other party, except in cases permitted by relevant legislation provisions; cannot use and cannot allow use for the benefit of other persons, institutions and organizations. The parties are obligated to take all measures to ensure the confidentiality of the Confidential Information listed above, take all kinds of measures in this regard, act in accordance with confidentiality principles, prevent unauthorized use of this information and take all measures to protect against all kinds of abuse.
The property right of any criticism submitted to the Platform belongs to Fanself and can be used by Fanself for marketing purposes if desired.
Protection of Personal Data
Fanself respects and attaches great importance to the privacy of members' personal information. Accordingly, personal data collection and use within the scope of the Platform is kept to a minimum and collected personal data is used for the realization of transactions.

Termination of Platform Use and Membership
If the member has any behavior contrary to the current legislation provisions or these Terms, Fanself may, entirely at its own discretion, review, freeze or terminate the personal account, membership records and similar uses on the Platform at any time. The payment obligation regarding orders placed before the termination of the member's account continues. In case of account termination, the member will have no account or similar membership rights on the Platform. Liability limitations and various provisions under these Terms continue to remain valid after such termination. Fanself may send notification about the termination of the account through the contact information provided by the member through the Platform.
The member agrees to compensate exactly for any damage that Fanself will suffer due to their action contrary to the obligations undertaken with this Agreement. Fanself has the right to recourse exactly to the member for any compensation and/or administrative/judicial fines that it may have to pay to public institutions and/or third parties due to the member's behaviors contrary to the Agreement.
